ICJ says, Pakistan cannot hang Kulbhushan Jadhav till final proceedings!

The International Court of justice –ICJ stands in right to justice and gives a big reason for India to get the good news. The India won over the massive diplomatic issue and the court orders for the execution of Kulbhushan Jadhav. Further the right to consular access to the former naval officer was also granted by the ICJ. The final verdict of the case is likely to be expected in the month of August. The case indirectly calls for massive win for India. The Judge Ronny Abraham had said,” the court finds in favor of India’s plea that no execution of Jadhav should be allowed until it has disposed the case.”

The International Court of justice had further said that all the arguments, rights and others invoked by the India are plausible and all of them are very strong point valid to be taken into consideration. There was also noticed further that the Vienna convention did not exclude the people who were found guilty suspected to be found under terror and espionage. Moreover, not only this, the further notice action was done by the court which makes the charges fall within Article 36 of the Vienna Convention and the dispute about the consular access.

However, the Jadhav’s arrest circumstances are said to be disputed by the judge and the plea was further made in the UN court with a view to solve the disputes happening between the two nations. The decision of the court are considered to be final  which means there is no source to enforce any of its ruling in any way and cannot be ignored at all. The argument made by India has invoked the Article 36 of the Vienna convention and later accused the Pakistani for “egregious violations of the Vienna Convention on consular relations.”

Moreover, the Indian arguments had also pushed further for an oral submission to present before the court and had also asked the Pakistan to take all the necessary measures to ensure that Jadhav is not executed until ordered for by the court.  On the other side, no action taken might prejudice India’s or Jadhav’s rights with respect to any of the decision taken by the court taking the merits factor into consideration.  This case will get the verdict alter in the month of August and we just have to wait and see what will happen till then.
